Terms of Use (SaaS)

Article 1 (Purpose)

These terms govern the rights, obligations, liability, and other necessary matters between the user and Idea Milkit ("Company") regarding the use of AI automated tools and related SaaS platforms.

Article 2 (Disclaimer of Warranties and Limitation of Liability)

This is a core clause for the Company's exoneration.

1. The Company provides the platform "As Is" and "As Available". The Company makes no express or implied warranties regarding suitability, performance, accuracy, or harmlessness.
2. Incompleteness of AI results: The platform generates images based on AI. The Company does not guarantee accuracy, realism, copyright non-infringement, or quality. Unexpected images may be generated, and users cannot hold the Company liable.
3. Indirect Damage Exoneration: The Company is not liable for loss of profit, data loss, credit damage, or any special, incidental, or punitive damages arising from using the platform.

Article 3 (Rights to Content and User Responsibility)

1. User Responsibility: The user bears all responsibility for legal disputes (copyright, portrait rights, etc.) arising from uploaded data.
2. Prohibition of Illegal Use: Users must not use the platform for illegal purposes such as defamation or creating exploitative materials. The Company may immediately suspend access and take legal action upon violation.
3. Ownership of generated content: The Company strives to grant copyright to the user, but the establishment of legal copyright for AI-generated results may vary by local law, which the Company does not guarantee.
4. 생성물 학습 활용 동의: 플랫폼을 통해 생성된 모든 이미지는 추후 당사 AI 모델의 고도화 및 서비스 품질 개선을 위한 학습 데이터로 활용될 수 있습니다. 이용자는 생성 기능의 이용과 함께 이에 자발적으로 동의한 것으로 간주됩니다.

Article 4 (Paid SaaS and Credits)

1. Credits charged for platform use are considered consumed when the generate button is pressed, and refunds cannot be requested because the result does not meet subjective satisfaction.
2. Credit Expiration: Charged credits are valid for 1 year (365 days) from the date of purchase. Expired credits are destroyed automatically without notice and cannot be refunded.
3. Refunds are generally not permitted unless a system error or defect is proven.

Article 5 (Indemnification)

1. User's Liability: If the Company faces claims or lawsuits from third parties due to the user's illegal acts or violation of these terms, the user must indemnify the Company at their own expense and compensate for any damages incurred by the Company.
2. Force Majeure: The Company is not liable for damages caused by the inability to provide the platform due to force majeure events beyond its control, such as natural disasters, server hosting failures, or DDoS attacks.

Article 6 (Platform Restriction and Termination)

1. The Company may restrict platform use or delete accounts without prior notice if the user violates these terms or interferes with normal operations.
2. In this case, remaining credits will be lost, and the Company will not compensate the user.

Article 7 (Governing Law and Jurisdiction)

Disputes between the Company and the user are governed by the laws of the Republic of Korea, and the court with jurisdiction over the Company's headquarters shall have exclusive jurisdiction.

Copyright and Legal Usage Notice

1. Unauthorized use, illegal copying, and distribution of any images and results from this platform are strictly prohibited. Violations may result in civil and criminal penalties strictly enforced by law.
2. Furthermore, the use of the service in an abnormal manner or the creation and abuse of illegal content will result in immediate restriction of service and strong legal liability.
